§1 Scope of Application

(1) These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed by consumers via the online shop at http://www.sirenite.com at

(hereinafter referred to as "we" or "Saltmate").

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity (§ 13 BGB).

(3) The version of these GTC valid at the time of the order is decisive. We do not recognise differing conditions of the customer unless we have expressly agreed to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of products in our online shop does not constitute a legally binding offer, but rather an invitation to the customer to order goods (invitatio ad offerendum).

(2) By clicking the button "Buy" in the final step of the ordering process, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping basket.

(3) We confirm the receipt of the order immediately by email (order confirmation). This does not yet constitute acceptance of the offer unless we simultaneously declare acceptance therein.

(4) The purchase contract is concluded when we accept the order by an explicit declaration of acceptance (order confirmation) via email or dispatch the goods - depending on which event occurs first. The acceptance period is [e.g. 5] days after receipt of the order.

(5) The contract text is stored by us. The order data and these terms and conditions will be sent to the customer by email. The language of the contract is German or English. 

§ 3 Prices and Shipping Costs

(1) All prices stated are final prices in euros and include the statutory value-added tax.

(2) In addition to the stated prices, shipping costs may apply, which will be displayed to the customer during the ordering process before placing the order.

§ 4 Payment

(1) We offer the following payment methods: credit card, PayPal, Apple Pay, Google Pay, instant transfer, gift card.

(2) If a payment method processed by a payment service provider is selected, the payment processing will be carried out by the respective provider; their terms and conditions also apply.

(3) We reserve the right not to offer certain payment methods in individual cases.

§ 5 Delivery and Delivery Times

(1) Delivery is made within Germany as well as to all countries of the European Union.

(2) The delivery time is, unless otherwise stated for the respective item, 2–4 working days after the conclusion of the contract (in the case of prepayment after receipt of payment).

(3) If an item is not available, we will inform the customer immediately; any payments already received will be refunded immediately in this case.

(4) Unless expressly agreed otherwise, delivery will be made to the delivery address specified by the customer. The shipping risk is borne by us in consumer transactions (§ 475 para. 2 BGB).

§ 6 Retention of Title

The delivered goods remain our property until full payment has been made.

§ 7 Right of Withdrawal

(1) Consumers have a statutory right of withdrawal of 14 days. The details are set out in the withdrawal information, which can be accessed at [LINK TO WITHDRAWAL INFORMATION] and is provided to the customer with the order confirmation.

(2) The right of withdrawal expires prematurely for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (§ 312g para. 2 no. 3 BGB).

§ 8 Gift Cards

(1) Gift cards can only be redeemed for the purchase of goods in our online shop, not for the purchase of further gift cards. A cash payout of the balance is excluded; this does not apply if a statutory right of withdrawal is exercised.

(2) If the balance is not sufficient for the order, the difference can be settled using the available payment methods. Remaining balances will be retained and can be redeemed for future orders.

(3) Gift cards are redeemable for three years from the end of the year in which they were purchased.

§ 9 Warranty (Defect Liability)

(1) The statutory rights of liability for defects apply. The limitation period for statutory claims for defects for new goods is two years from delivery.

(3) Information on the proper care of the products (e.g. salt and chlorine water, sunscreen) can be found at http://www.sirenite.com/pflegehinweise. Damage resulting from improper handling contrary to the care instructions does not constitute a defect.

§ 10 Consumer Dispute Resolution

We are not willing and not obliged to participate in dispute resolution procedures before a consumer arbitration board within the meaning of the Consumer Dispute Resolution Act (VSBG).

§ 11 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. This choice of law applies to consumers only to the extent that it does not deprive them of mandatory consumer protection provisions of the state in which the consumer has their habitual residence.

(2) Should individual provisions of these GTC be wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected.
